Winding Up Petitions

If your business owes £750 or more to a creditor they can pursue you for the debt by issuing a winding-up petition. You only have 7 days from the date the petition is issued to take action. If you don’t take any action your company will most likely be at risk of liquidation.  This means your company immediately ceases trading and the assets are sold to pay creditors.

Navigating the Critical 7 Days with GMD

In the intricate world of business finance, the issuance of a winding-up petition is a momentous event with profound consequences. When a business owes £750 or more to a creditor, they have the option to pursue the debt by issuing a winding-up petition. The clock starts ticking the moment the petition is issued, and you have just 7 days to take action. The stakes are high, as failure to act promptly places your company at significant risk of liquidation.

The Harsh Reality of Liquidation

Liquidation is a process that sends shockwaves through any business. It entails the immediate cessation of trading operations, and the company's assets are sold to repay creditors. When a winding-up petition is issued, the matter becomes public knowledge, as these petitions are advertised in the London Gazette. Additionally, the affected company's bank accounts are frozen without warning or further access.

Unless the winding-up petition is settled or successfully set aside through a court application, the company faces dissolution and falls under the jurisdiction of the Insolvency Service. During this tumultuous period, the appointed liquidator conducts a thorough investigation into the company's affairs, as well as the conduct of its directors, to ensure there is no fraudulent activity or wrongful trading. Transactions from the previous 2 to 5 years are scrutinized.
